- ItemDIGITAL EVIDENCE IN PERSONAL DATA CRIMES(2026-05-23) YKHLEF DJAMEL ABD NASSER; DJEZZAR MOHAMED ZAKIRapid developments in the digital environment have led to the emergence of new forms of crime, particularly those related to personal data, making digital evidence an essential tool for their detection. Digital evidence relies on electronic data to establish criminal facts and is characterized by its intangible nature and vulnerability to alteration or manipulation. Such evidence requires a precise legal and procedural framework to ensure its legality and integrity during collection and use. Algerian legislation provides a set of rules governing digital evidence, particularly through laws related to personal data protection and criminal procedures. Personal data includes any information that allows the identification of an individual, directly or indirectly, requiring effective legal protection. Personal data crimes include illegal access, espionage, unlawful modification, and unauthorized disclosure. The proof of these crimes depends mainly on digital traces such as system logs, electronic records, and usage data. The collection of digital evidence is subject to strict legal controls, especially the principle of legality and respect for procedural rules. The nature of digital evidence requires maintaining its integrity through proper documentation and protection against tampering. Technical expertise plays a central role in analyzing and interpreting digital evidence before the courts.
